It is with the Department of Labor in Tennessee, tied in with boiler inspectors and elevator inspectors.  Thought they were originally with Commerce and Insurance before they were moved.  They are in a weird place where they don't quite fit in with the stated mission of just about any department but someone needs to house them.

Yeah, I don't get it. They are two different votes, conviction and penalty. You need a unanimous jury to convict and I've assumed you also need a unanimous jury for a specified penalty. So the new law is that you no longer need a unanimous vote on s specific penalty? How does that work?

And for the record, according to wikipedia, capital punishment in Florida is only for murder, with 16 types of, I guess, caveats, e,g,:

8. It was especially heinous, atrocious, or cruel.
9. It was committed in a cold, calculated, and premeditated manner without any pretense of moral or legal justification.
etc.

With this last bit:

Florida statute also provides the death penalty for capital drug trafficking and discharging or using a destructive device causing death. A provision for capital sexual battery was found unconstitutional in the 2008 U.S. Supreme Court case Kennedy v. Louisiana. No one is on death row in the United States for drug trafficking.

This could have an unintended side effect. Now any juror knows that the death penalty is likely to follow any conviction of a capital offense. They may just vote not guilty more often.

Yeah I could see that. In jury instrux it would go something like this, "You must be unanimous in your vote to convict. However, if a unanimous conviction vote is achieved you need not be unanimous in your penalty vote, up to and including the death penalty."

During a trial, one might feel someone is guilty but not feel the person should be killed. They might back away from a Yes vote in the conviction phase to safeguard that notion.

I thought the judge did the sentencing.
In most cases yes, but not when it comes to capital punishment.  This is likely so that sentencing to death isn't the in the hands of a single person.  The jury for the sentencing may also not be the same jury for the trial.

I disagree with this.  I prefer my child rapists to live a long, healthy life full of pain and suffering.  Constant prison rapes, solitary confinement, bad food, etc...
