She's not even directly demanding that Hunter should be prosecuted in the video. She is criticizing law enforcement for ignoring these crimes and not prosecuting anyone.

Tho there is the issue of admissability of evidence.  As I'm sure Tom is an expert on, not all evidence obtained can be used in court.  Illegally obtained evidence, such as a laptop that was illegally given to the republican party by a repair shop, may not be admissable in court.

Short answer:
Since the government (FBI) didn't get the evidence in a legal way (the GOP basically stole the laptop and hacked into it) then no evidnece on that laptop is admissable in court unless it was inevitable that the FBI would get the evidence.  Since it wasn't, they can't even get a warrant to gather more evidence.

So if MTG knew anything, she'd know that because the GOP took the laptop illegally and went through it (also illegally) for evidence of wrongdoings, the entire laptop is worthless as evidence.

Like if I were to sweet talk some IT professional into giving me their password then I accessed the company network with his password, I just hacked the system.  Technically speaking.

And unless Hunter Biden had no security on his laptop, they must have logged in somehow. Or taken out the drive and read the data.  Or, the laptop shop gave them the password that Hunter gave them to log in.
In any case, the only people authorized to access the laptop were the people at the repair shop and Hunter Biden.  Anyone else and its hacking and therefore illegal.

This is informed speculation on my part but I think a repair shop would require you to unlock it with the understanding that the contents of that device are kept confidential.

So I'm guessing it wasn't exactly hacked but that evidence might be unusable under the circumstances.

I am apparently... Misinformed.
It seems the law is fuzzy.  There is a law in Delaware stating that abandoned property becomes the property of whoever has it.  But that only applies to tangable items.  Data or copywrites do not transfer over.  But this is personal data on a HDD so the law is untested.
