I call it a failure to show that Trump asked people to incite violence at the Capitol.
Tom, you have to understand the audience that Trump is talking to.
If you whip up a crowd like this into a frenzy, what else could you possibly expect when you tell them to march to the capitol and fight like hell to take their government back?
Trump literally said to be peaceful and to strongly make your voice be heard at the Capitol.
Your "what do you expect would happen" isn't enough to convict someone in court for incitement of violence. You are putting forward your personal interpretation of the state of mind of hundreds of people you don't know and Trump's true unstated motivations as fact.
Several months of Trump ranting about tens of millions of votes being stolen from him and an entire party committing massive voter fraud and how on the 6th he would fight to make it right, and everyone should come to the capital and fight had nothing to do with it, hmmm?
It's amazing how Trump worshipers can't even admit Trump had the slightest to do with a massive angry riot that was there for him.
You live in a fantasy land, and in that fantasy world it's perfectly ok to try and overturn the will of the people via armed violence. And when it fails, well you didn't do it!
This isn't some silly debate over if you think math exists, Trump clearly and impassionedly riled up his supporters for months, making them angry and upset and pointed them at a target. You can't weasel your way out of responsibility for this one by pointing at a word here and there and ignoring the context.
And don't be so sure of your little court example. I'm pretty sure a jury of 12 sane people would see what the rest of us do, Trumps constant screaming at people about how the election was a massive scam and rigged was absolutely the cause. If you scream "Oh my God I think there might be a fire!" in a crowded theater, no jury in the world will let you off because you said "might".
