Man sues McDonald's 10 mil because allergic to cheese.
« on: August 13, 2007, 05:22:03 PM »
*Man orders burger, asking for no cheese.
*Man goes home eats burger in dark.
*Man claims he was "near death" when he went to the hospital.  Hospital bills were $700.
*Man sues McDonald's $10 mil.

Discuss.

I wish I was allergic to something in McDonald's food, then I'd do the same thing.

Almost as ridiculous as the lady that sued because a pickle burned her lip.  I don't remember the outcome of that lawsuit.  I sure hope that she lost and McD's made her pay the court fees.

I hate corporations (especially McDonaldsas much as the next guy, but most of these ridiculous cases I side with the corporations--consumer stupidity shouldn't fall onto their shoulders.  This case is no different from, say, "I'm allergic to having my fingers chopped of by a lawnmower, but I'm not going to make sure the blade is no longer spinning before I try to take it off to replace it."  This guy should have checked to make sure there was no cheese on it.

Well, I could understand MAYBE suing for the hospital fees...But ten million dollars? What led him to THAT MUCH? Trauma? I don't think he sustained $9,999,300-worth of emotional or long-standing physical damage from an allergy.

Suing for hospital fees in small claims court seems entirely reasonable. If they'd given him what he asked for he wouldn't have had to go to the hospital. But 10 million dollars? If there was no lasting damage, then he doesn't deserve anything more than the hospital fees, which McDonald's has already offered him to settle. Also, I find the fact that "he took at least five independent steps to make sure that thing had no cheese on it" but none of them involved actually looking at it strikes me as hilarious. I can't believe he found a lawyer willing to take the case.

LOL!  Ffs.. How is the last, and most common sense, step not opening and looking at the finished burger for cheese?

This guy should be forced to eat another burger with cheese, so he'll remember to check for it next time.

Right, because dimwitted and litigious assholes deserve to be forcefed allergens which have a chance of killing them. If justice were really as blind as that, half this forum should have been dead a long time ago.

I just hate the American (and growing British) trend of suing everyone when something bad happens. Instead of going ohh that was a mistake I shouldn't do that again it's ohh he made a mistake! I'm gonna make sure he can't afford to do anything like that again

There was this one dude who borrowed the city dump truck, backed into both his car and his garage, sued the city, and won.

Do by borrowed you mean stole?  Or simply took it under verbal agreement so he could get away with suing?

That's your job! You brought it up! A guy once sued his insurance agency. Now go look it up. Nah, I'm kidding, he insured 25 cigars against fire, then smoked them, and sued for a million-ish. He was then immediately arrested and convicted of 25 counts of arson with intent to commit insurance fraud, or the like, fined for $30K, and had the money he had "earned" from the lawsuit returned to the company.
No but I'm guess your what? 90? Cause you just so darn mature </sarcasm>

I hope he wins. He ordered a burger without cheese. If I ordered a burger without severed penis, and it came with a severed penis, I would be pissed off too.

But are you allergic to severed penis? And the argument isn't whether he should get compensation for the medical bills, it's whether he should get TEN MILLION DOLLARS for it.

I'm even kind of skeptical as to whether he should even get reimbursed for the medical bills, since he's evidiently too stupid to check to see if his burger had cheese on it first.  I check to make sure I get the right order before I eat anyway--I'm sure if I were allergic to something, I would definitely look before I start nom nom nom noming away.

Wrong, this is clearly Mcdonalds fault, he clearly was allergic.

If it almost cost him his life, $10M is asking too little. I am offended they even take such a small number seriously in court.
