It looks like she consented to sex with him WITH a condom, and then it was either removed or broke during intercourse meaning he had sex with her outside of the consent she gave.
Would this make accidentally putting it in the wrong hole rape? What precedents would this lead to? Would premature ejaculation be rape if the woman consented to a long session of sex? Would going too long be rape if she asked for a quickie?
In my opinion consent really should cover everything, and the woman should have to verbally remove her consent if she doesn't like the way sex is going.
Modify: it also appears the women didn't file a police report they "went to the police for advice on the issue" a technique in sweden that prevents you from being charged with falsely accusing someone of a crime. This means that no matter how the case turns out, their lies won't get them in trouble.
