I had thought MP3 was based off open standards.  However, I either way I can't give you permission as its not mine.  Ask the folks at Strange Frequencies (or I will) and I'm sure they won't mind.

While the MPEG-1 specification is freely available, mp3 is subject to patent restrictions in certain jurisdictions (including the United States), which unfortunately prevents it from being an acceptable free format for international content distribution.
