It is and has always been legal for a man, whether gay or straight, to marry a woman. This is about providing special treatment to allow gay men and lesbian woman to marry people of the same sex. While I do see where your coming from Proposition 8 did not preserve the status-quo in California it reversed a previous decision granting same-sex marriage and thus was technically depriving them of a right they enjoyed up at the time the Proposition was put on the ballot. In any case regardless of my views on same-sex marriage the whole idea of using a referendum to determine minority rights is one I find abhorrent.I is democracy in the pejorative sense, rule of the mob (which is what the word democracy actually means, it was originally a pejorative coined by supporters of aristocracy)

So?  Why does anyone care what two adults do, as long as they're not hurting anyone? The religious are in an uproar because the US is becoming more tolerant of gays. They claim that they are defending marriage. Has the divorce rate gone down in any state that has made gay marriage illegal?  If they really want to protect marriage, maybe they should make divorce illegal.
