I believe he was always going to be executed. The degree of his involvement in, and his responsability for, the September 11th attacks was never going to affect the outcome.

The 'executive branch' need not have had anything to so with it. He was always going to be killed. Whether the trial was fair or not doesn't matter. Nobody accused of causing the attacks has been killed; no pound of flesh has been extracted. That he had anything to do with it automatically meant he was going to be killed, because they need to kill somebody, almost as a rite of excorcism.

He was a hero when US supported him in the war against russians in Afganistan, but since US droped it's support after the fall of USSR and simply left his country in ruins, than he did many bad things to a lot of american people. So in the end, I think both Bush and Laden deserve a fair trial for their crimes against humanity.

Are you saying that Bush was responsible for the US dropping its support of Afghanistan?  Or what "crimes against humanity" are you referring to as far as Bush is concerned?

But Dionysios war and the death penalty are as you said two different things. TO kill an enemy soldier who is trying to kill you is not the same as walking into the White HOuse and shooting President Bush. ranted nor is it the same as gunning down a civillian of either side. However you muswt keep in mind when talking about civillian casualties in Iraq or anywhere, that they are not all intentional. People really to accidently get shot in exchanges between two groups of soldier cruise missles really do (sometimes) accidentally destroy civillian instead of military targets. This is especially true in the urban fighting that takes place in Iraq.
This doesn't make civilain deaths any less wrong but it is something to keep in mind

Keep in mind that these are distinctions that WE make, not Islamic fundamentalist terrorists. They can hold us to follow things like the geneva convention but we cannot hold them to follow it. Also a soldier/fighter not in a uniform and identified as a combatant can be executed if caught or shot down in combat according to the Geneva convention. That means we can just kill off every terrorist or hold them prisoner indefinatly without reproach from the geneva convention. All that stuff about illegal prisoners in cuba is rubbish as there is no legal standing anywhere(they aren't US citizens, they aren't offical enemy combatants).

Also, the stuff about Moussawi, yes you can be tried just on intent. Just because you catch someone before they do a crime doesn't mean they aren't guilty of doing it. My GF is going over intent in lawschool this week and has been blabbing my ear off about it heh.
