Huh, in some places, every driver has agreed to take a breath test whenever asked for and for whatever reason. Refusal will result in the suspension of driving priviliages.

Ah, so sacrifice your freedom for a bit more safety.

The police can pull over a driver whose driving has shown them to be unsafe. Simply doing this has cut down drunk driving accidents by a very large amount. Since drunk driving laws have been more readily enforced the drop has been 8,000 deaths per year. (Please remember that driving deaths are the number one accidental cause of death in america so not every drunk driving death was caused by alcohol, it is simply involved in some cases.
You still have the freedom to not drive.

You do have the right not to be breathalized for no reason.

Again, the rights of the individual trump the rights of the police. Should the police also be able to cut you off to make sure you are paying attention to the road? Should they be able to randomly stop every car and search them for contraband? Like you said, it is illegal to have drugs, shouldn't they be able to search us for them at all times?
Like I said earlier, in some areas just having a drivers license means you've already consented to submit a breath test whenever it is asked of you for any reason.

Isn't this an unreasonable search? Your searching someone without probable cause.

Also, they aren't infringing on people's rights. They are free to search if you give consent, and if you don't consent too a breathalyzer test, that could be considered probable cause, so you'd get one anyways.

No, refusal to consent to something is not probable cause of anything, and can never be legally held against you.  That would defeat the entire purpose of "consent" in the first place.

Actually, I think in most of these united states, when you get your license you basically enter into an agreement to submit to the breath test whenever the police ask you to. Refusal usually results in the loss of driving privileges for a certain length of time whether intoxicated or not.

I picked this game up recently, its fucking awesome. I kinda like GTA before, but with rdr I will never have to play GTA again.
Haven't fooled around with that yet. I got plenty to keep me occupied for now

I only have one criticism, I'm disenchanted with the zombie add-on.  It just doesn't mesh.
